We reserve the rlght to this exception which is, the disclosure of information to a recognized law enforcement agency and only when such an action is required by lawful procedures.
Know also, that the decision for compliance with such a request or demand would not be upon the personal judgment of any single employee, employees, manager or owner of Greenville Pharmacy.
Compliance with such a request would be a decision by the court and would require the service of a written court order.

Court Orders

Court Order:

A HIPAA-covered health care provider or health plan may share your protected health information if it has a court order. This includes the order of an administrative tribunal.
However, the provider or plan
may not disclose any information that is not specifically described in the order.


A subpoena issued by someone other than a judge, such as a court clerk or an attorney in a case, is different from a court order.
The term "subpoena" literally means "under penalty".
A HIPAA-covered provider or plan may disclose information to a party issuing a subpoena only if the notification requirements of the Privacy Rule are met.
Before responding to the subpoena, the provider or plan should receive evidence that there were reasonable efforts to:
-Notify the person who is the subject of the information demand so that person has a chance to
-object to the disclosure, or...
-be given the opportunity to seek a qualified protective order for the information requested by subpoena.

In most all instances the subpoena will be issued and signed by an attorney on behalf of a court in which the attorney is authorized to practice.
Since we are a health care provider the type of subpoena will normally be a subpoena duces tecum. This type compels the production of specific data. It cannot be used to require oral testimony.

These messages will contain information regarding various products and services which we believe would be of interest to you.
